Back to those questions... well, No. (1) looks very solid. If I don't sign that contract on December 1st, you'll sue me and win. No. (2) is weaker, but it's still okay. If the bank approves my mortgage application, I have to perform. If I don't, you'll sue me and win. But people would have a problem with No. (3), which says, "I'll buy your house when I feel comfortable." What's that supposed to mean? It's utter nonsense.

It's nonsense because one side has all the control. If I say, "I don't feel comfortable with the finances," I'm off the hook! In contract law, we call this an illusory promise. It's indefinite. It's vague. "Feeling comfortable" means absolutely nothing here. That's why such promises are not acceptable. Like the "illusion" of a hokkabaz, the "illusory" promise is just that... the illusion of a legally valid promise.
