About twenty years ago, there was a famous lawsuit where a woman sued McDonald's for burns from hot coffee. She picked up the coffee at a drive-thru window. She placed the hot coffee cup between her knees to add sugar and milk. The coffee spilled and caused second and third-degree burns on the insides of her legs. The case made national headlines. People joked that you could get a million dollars for spilling hot coffee on yourself. But there's more to the story.

The McDonald's lawsuit comes to mind because there have been other recent lawsuits in the news about burns from hot coffee. This shows that hot coffee lawsuits are not over. In the McDonald's case, it didn't start as a lawsuit. At first, the customer requested payment of medical bills, home care, and lower temperatures for coffee. When the woman and McDonald's weren't able to reach an agreement, her attorney filed a lawsuit in federal court. The result was a verdict of roughly $3 millon, which was later reduced.

The hot coffee lawsuit involves an interesting area of practice known as product liability law. It deals with injuries from defective products. This includes tires blowing out on highways, SUVs rolling over in high-speed turns, side-effects of dangerous drugs, toys containing toxic substances, etc. If you turn your TV on late at night, some of the attorney advertisements you see are about product liability. The narrator asks, "Were you injured by this product? You may have a case. Call us!"

Product liability cases are different than car accidents or slip & fall accidents. They are based on the fact that a product was dangerous or defective. You may ask, "What is dangerous about coffee?" It is something found in everyone's kitchen. That's true, but coffee lawsuits can focus on the TEMPERATURE of the coffee and the need to WARN about such a danger. In the McDonald's case, attorneys claimed that coffee temperatures were dangerously high, which were in the range of 185 degrees F. If someone is accidentally burned, what should they do? The next time you're enjoying a cup of hot coffee from a drive-thru window, carefully look for fine print on the styrofoam or paper cup. You'll probably see words that read, "Warning - Contents Hot." That warning is a result of product liability law. This won't change how people feel about coffee. Most people love it and can't live without it. What does this mean for the person who spills hot coffee on themselves at a fast food place? Will they have a million dollar case? Chances are that in most instances, they will not. This happens every day. And every setting can be different, depending on the temperature of the coffee, the way it was served, the design of the cup, the injuries sustained, and other factors.
